1. About these terms
This website is operated by Charlie and Ash Limited, a New Zealand registered company, trading as Charlie & Ash (“we”, “us”, “our”). By using the site you agree to these terms. If you do not agree with them, please do not use the site. These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute.
2. Coaching is not medical or clinical care
This is the important one, so please read it.
Charlie & Ash provide health and wellness coaching. Our coaching, this website, the quiz, the handbook, and any content we publish are for general information and support only. They are not medical, clinical, psychological, nutritional, or other professional advice, diagnosis, or treatment, and they are not a substitute for care from a qualified health professional.
- The quiz is a moment of reflection, not a clinical assessment or a diagnosis.
- Always seek the advice of your doctor or another qualified professional about a medical or mental-health condition, and before making changes to your health, diet, or exercise.
- Never delay or disregard professional advice because of something you read here or in our coaching.
- If you are in crisis or think you may have a medical emergency, contact your local emergency services (dial 111 in New Zealand) or a helpline such as 1737 (free call or text, any time).
You are responsible for your own choices and actions. Coaching supports you to make them; it does not make them for you.
3. No guaranteed outcomes
Coaching outcomes depend on many things, most of them yours: your circumstances, your effort, and your consistency. Any results, examples, or testimonials we share are illustrations, not promises. We do not guarantee any particular result.
4. Our offerings
The website describes our current offerings, which may include one-to-one coaching, our group programme (Evolve), and in-person events. Availability, format, and pricing can change, and nothing on the website is an offer capable of acceptance on its own.
When you join a paid programme, the specific terms of that programme (what is included, dates, payment, and cancellation) are set out in the agreement you receive when you sign up, or as stated at the point of booking. Those programme terms sit alongside these website terms; if the two ever conflict for a paid programme, the programme agreement applies.
5. Bookings and payments
Bookings and payments are handled through our booking and payments provider. Fees, and any deposit, are shown before you confirm. Cancellation, rescheduling and refund terms for each programme or event are part of its agreement or shown at the point of booking. Where the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 apply, your rights under those Acts are not affected by anything in these terms.
6. Using the website
You may use the website for your own personal, non-commercial use. Please do not misuse it: do not attempt to interfere with it, access it in an unauthorised way, or use it to break the law.
7. Our content and brand
The website content, including The Aliveness Method, the Charlie & Ash name and brand, text, images, and design, belongs to us or our licensors and is protected by intellectual property law. You may read and share links to it, but please do not copy, republish, or use it commercially without our permission.
8. Links to other sites
The website may link to other sites (for example our booking page, or a podcast host). We are not responsible for the content or practices of sites we do not control. Their terms and privacy notices apply when you visit them.
9. Your information
We handle personal information as described in our privacy notice. Please read it to understand what we collect and why.
10. Our liability
We provide the website and its content in good faith and take reasonable care with them, but to the extent the law allows, we are not liable for any loss or harm arising from your use of the website, the quiz, the handbook, or our free content, or from your reliance on any of it. Nothing in these terms limits any rights you have under New Zealand consumer law that cannot be excluded (including the Consumer Guarantees Act 1993).
11. Changes to these terms
We may update these terms from time to time. The current version is always the one on this page, with the “last updated” date above. Continuing to use the website after a change means you accept the updated terms.
